After an extensive review by the MLS Committee of the MLS violations policy and the existing fine structure, the Board of Directors approved a measure to introduce escalating fines for members who do not comply with repeated violation warnings. The new fine structure (outlined below) will take effect Monday, June 12, 2017.
Members who violate MLS policies on a repeated basis will see escalating fines placed on their MLS bill for any MLS listing violations which are left uncorrected in an active, active-pending, pending or withdrawn status in the MLS. A copy of the new fine structure is also located in Matrix MLS in the “Links” section.
New MLS Violation Fine Structure
For first offense:
- For failure to correct violation after 3 warnings are issued, first fine is billed to account for $25.00.
- For failure to correct violation 72 hours after first fine is issued, fine escalates to additional $50.00 and is billed to account. ($25 of first fine + $50 second fine = $75 total fine)
- For failure to correct violation 72 hours after second fine is issued, fine escalates to additional $75.00 and is billed to account. ($25 of first fine + $50 second fine + $75 third fine = $150 total fine)
- For failure to correct violation 72 hours after third fine is issued, fine escalates to additional $100.00 and is billed to account. ($25 of first fine + $50 second fine + $75 third fine + $100 fourth fine = $250 total fine)
- For failure to correct violation 72 hours after the fourth fine is issued, an additional $100 will be billed to the account every 72 hours until the violation is corrected.
For additional offenses of the same violation within one year of the date of the first violation:
- For failure to correct violation after 3 warnings are issued, first fine is billed to account for $50.00.
- For failure to correct violation 72 hours after first fine is issued, fine escalates to additional $75.00 and is billed to account. ($50 of first fine + $75 second fine = $125 total fine)
- For failure to correct violation 72 hours after second fine is issued, fine escalates to additional $100.00 and is billed to account. ($50 of first fine + $75 second fine + $100 third fine = $225 total fine)
- For failure to correct violation 72 hours after the third fine is issued, an additional $100 will be billed to the account every 72 hours until the violation is corrected.
